1. Who we are

The Mat is a pilates and sculpt studio located at 1429 San Marco Blvd., Ste A, Jacksonville, FL 32207. We are the party responsible for the personal information described in this Policy. This Policy applies to our website, our studio, and the class booking, membership, event and communication services we provide. It does not apply to the separate privacy practices of the third-party platforms we use, which are described in Section 10.

2. Information we collect

Information you give us

  • Contact and account details: your name, email address, phone number, mailing address, date of birth, emergency contact, and the login details you create with our booking platform.
  • Booking and membership records: the classes, class packs, memberships, events and workshops you purchase or reserve, your attendance, cancellations, no-shows, waitlist activity, credits, membership status and billing history.
  • Waivers and agreements: the liability waiver, membership agreement, studio policies and any other documents you sign, including the date and manner of signature.
  • Messages and inquiries: what you send us through our contact form, our "sign up for information" form, email, text message or social media, including anything you choose to include in those messages.
  • Optional details: preferences, class feedback, survey responses, referral information and reviews.

Information we collect automatically

When you visit our website, our hosting provider and the third-party services embedded in our pages may receive standard technical information, including your IP address, device and browser type, operating system, referring page, the pages you view, and the date and time of your visit. This information is used to deliver and secure the site and to understand general usage patterns.

Information we receive from others

We may receive information about you from our booking and payment platform (for example, confirmation that a payment succeeded or failed), from social media platforms if you interact with our accounts or advertising, and from a person who books a class or buys a gift for you.

3. Health and fitness information

To keep you safe in class, you may choose to tell us about injuries, pregnancy, medical conditions, physical limitations or other health details, and you may provide that information on a waiver, health questionnaire or directly to an instructor. We treat this information as confidential and use it only to assess your suitability for class, to adapt or modify movement for you, to respond to a medical emergency, and to comply with law.

We are not a healthcare provider, and we are not a "covered entity" under the Health Insurance Portability and Accountability Act (HIPAA). Health information you share with us is therefore not HIPAA-protected health information, although we still handle it as confidential as described in this Policy. Please share only the health information you are comfortable sharing, and understand that withholding relevant information may affect our ability to keep you safe.

4. Payment information

Payments for classes, class packs, memberships, events and fees are processed by our third-party booking and payment providers. We do not collect or store full payment card numbers on our website or on our own systems. Card details are submitted directly to the payment processor, which is responsible for safeguarding them. We receive and retain limited transaction data, such as the amount, date, description, the last four digits and brand of the card, the billing name and the outcome of the transaction, so that we can administer your account, apply fees and keep accurate financial records.

5. How we use your information

We use personal information for the following purposes:

  • to create and administer your account, membership, class pack or reservation;
  • to schedule classes, manage waitlists, check you in and track attendance and credits;
  • to process payments, recurring membership charges, late cancellation fees, no-show fees and refunds where we grant them;
  • to communicate with you about bookings, schedule changes, closures, studio news, events and your account;
  • to send marketing and promotional messages where you have consented or where the law otherwise permits, subject to Section 8;
  • to provide a safe class environment, respond to injuries or emergencies, and enforce our waiver, studio rules and Terms and Conditions;
  • to understand how our website and classes are used and to improve them;
  • to maintain records, resolve disputes, collect amounts owed, protect against fraud and misuse, and establish or defend legal claims; and
  • to comply with applicable law, tax and accounting obligations, and lawful requests from authorities.

6. How we share your information

We share personal information only as described below:

  • Service providers. Companies that operate our booking, membership and payment systems, our website hosting and content delivery, our email and text messaging tools, and our accounting and administrative software. These providers may process your information only to provide services to us.
  • Instructors and studio staff. Our teachers and staff may see the class roster, your name, and any health or injury information relevant to keeping you safe in class.
  • Event and workshop partners. If you register for an event we co-host, we may share the attendee list with the partner or venue where it is necessary to run the event. We will tell you at registration when this applies.
  • Professional advisers and insurers. Our attorneys, accountants, insurers and collection agents, where reasonably necessary.
  • Legal and safety disclosures. When we believe in good faith that disclosure is required by law, subpoena, court order or legal process, or is necessary to protect the rights, property or safety of The Mat, our members, our staff or the public.
  • Business transfers. In connection with a merger, financing, acquisition, reorganization or sale of all or part of our business, in which case the recipient's use of your information will remain subject to this Policy or a policy that provides comparable protection.
  • With your direction. Any other sharing you ask for or agree to.

7. We do not sell your information

We do not sell your personal information for money, and we do not share it with third parties for their own cross-context behavioral advertising. We also do not rent or trade member lists. If this ever changes, we will update this Policy and provide any notice and opt-out choice the law requires before the change takes effect.

8. Email and text message communications

If you give us your email address or phone number, we may send you transactional messages about your account, bookings, payments and classes. These are part of the service and are not marketing messages.

We send marketing emails and text messages only where you have signed up or otherwise consented. Consent to receive marketing text messages is not a condition of purchasing anything from us. Message and data rates may apply, and message frequency varies.

You can opt out of marketing emails at any time using the unsubscribe link in any marketing email, and you can opt out of marketing text messages by replying STOP to any message or by emailing us. Opting out of marketing does not stop transactional messages about your bookings, membership or payments, which you will continue to receive while your account is active. To stop all communications, you must close your account by contacting us.

9. Cookies and similar technologies

Our website uses a small number of cookies and similar technologies, and the third-party services embedded in our pages may set their own. These are generally used to keep the site working, remember your booking session, and understand aggregate site usage.

Most browsers let you block or delete cookies through their settings. If you block cookies, parts of the site — in particular the embedded booking and signup windows — may not work correctly. Because our booking windows are provided by a third party, blocking its cookies may prevent you from signing in or completing a purchase.

10. Third-party services and embedded content

Some pages on our site embed content and functionality from third parties, and some pages link out to them. When you interact with embedded content, or simply load a page containing it, that third party may receive your IP address and other technical information and may set its own cookies, all governed by its own privacy policy rather than ours. The main third parties we use are:

  • Mariana Tek (marianatek.com), our class booking, membership, scheduling and payment platform, which powers the booking, purchase and account windows on our Classes & Schedule, Pricing, Events and My Account pages;
  • Netlify, which hosts this website and delivers its pages;
  • Google Fonts, which delivers the typefaces used to display the site; and
  • Instagram / Meta, if you visit or interact with our social media profiles.

We are not responsible for the privacy practices, content or security of third-party services, and we encourage you to review their privacy policies before providing information to them.

11. How long we keep information

We keep personal information for as long as needed for the purposes described in this Policy: while your account or membership is active, and afterward for as long as necessary to complete transactions, honor a locked-in founding rate, resolve disputes, collect amounts owed, maintain required financial and tax records, defend legal claims, and comply with law. Signed waivers, incident reports and membership agreements are retained for the length of the applicable limitations period or longer where prudent. When information is no longer needed, we delete it or de-identify it.

12. How we protect information

We use reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse and unauthorized access, including limiting access to staff who need it, relying on reputable providers for booking and payment processing, and serving our website over encrypted connections. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep your booking account password confidential, and tell us promptly if you believe your account has been compromised. If a breach affecting your personal information occurs, we will notify you and any regulator as required by applicable law.

13. Your choices and privacy rights

You may, at any time, ask us to:

  • confirm whether we hold personal information about you and provide a copy of it;
  • correct information that is inaccurate or out of date;
  • delete information we no longer need to keep; or
  • stop sending you marketing communications.

Send your request to lindsey@thematpilates.co with enough detail for us to identify your account. We may need to verify your identity before acting, and we may decline a request where the law permits or requires us to retain the information — for example, records needed for accounting, waivers, safety incidents, or an unresolved balance or dispute. We will not discriminate against you for exercising these rights. Some of your information is held in our booking platform, and you can also review and update much of it by signing in to your account there.

Depending on where you live, you may have additional statutory rights, including rights under Florida law for Florida residents, and rights under the laws of other U.S. states or other countries. We honor the rights that apply to you. If we ever deny a request that you believe should have been granted, you may ask us to reconsider by replying to our response, and you may have the right to appeal or complain to your state attorney general or data protection authority.

14. Children's privacy

Our website and services are intended for adults. We do not knowingly collect personal information from children under 13. A parent or legal guardian must provide and consent to any information relating to a participant under 18, and must sign the waiver and agreements on that participant's behalf. If you believe a child under 13 has given us personal information, contact us and we will delete it.

15. Do Not Track signals

Because there is no common industry standard for interpreting them, our website does not currently respond to "Do Not Track" browser signals. We do not track you across unaffiliated websites for advertising purposes.

16. Where your information is processed

We operate in the United States, and our service providers may store and process information in the United States or other countries. If you access our website or services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those of your location.

17. Changes to this Policy

We may update this Policy to reflect changes in our practices, technology or the law. The "last updated" date at the top of the page shows when it was last revised. If we make a material change, we will post the updated Policy here and, where required, provide additional notice. Your continued use of our website or services after the update takes effect means you accept the revised Policy.

18. SMS and Mobile Information

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
